Arbitration Provisions

The United State Constitution provides for the right to a jury trial. Under contract law, however, an individual may forever waive their right to a jury trial if they sign a waiver or what is called an arbitration provision. If you are presented with an agreement to sign and it is of enough concern to you that you may want to preserve your right to a trial by a jury of your peers then it is in your interest to seek the advice of an attorney before signing such an agreement. If the agreement you are asked to sign has the word "arbitration" in it then you are likely giving up some of your constitutional rights simply by signing your name. Our office will always meet with you and explain your rights free of charge in these circumstances. Do not hesitate to call us before you sign such an agreement. At least this way you will know what you are getting yourself into.
