What is the Value of Being Healthy?

Texas law allows you to be compensated for your injuries.  We struggle with how to present those injuries in a way that juries can relate to.  For example, we put a premium on health in this country and it shows through the salaries of our professional athletes.  Their ability to run and play affords them the right to earn millions.  Another potential marketplace for determining the value of injuries is in the cost of medical treatment.  Obviously, if a person will pay a given price for health care then you have to assume that their being well is worth at least that amount of money.

In civil suits attorneys can not request medical treatment in kind.  Instead, we have to ask for a monetary award to allow for treatment.  Sometimes, however, when an injury can not be fixed by a doctor there is still a need to compensate the injured party.  The injury is there and certainly the client would have rather not had the injury because they suffer with it every day.  Looking to the health care market and towards what society is willing to pay the healthy individual in other circumstances provides some basis to determine the fair compensation for that injury.

Fatal Auto-Accidents

When a loved one is killed in an auto-accident time can be of the essence. Often, your thoughts are not focused on gathering the necessary information to present a claim to an insurance company or at-fault party, which is understandable. The reality is, however, that the most valuable evidence to support a claim is gathered in those first days, weeks, and months after a tragedy. Insurance Claims

Hurricane associated insurance claims have become quite popular as of late, but did you know that in the event of fire or theft loss you may also have an insurance claim that warrants your seeking legal advice?  With any insurance claim comes the likelihood that you will be underpaid.  Keep in mind, insurance companies are in business to make as much profit as they can.  One of the ways they do this is by undervaluing claims.

As a general rule, therefore, if you have a claim of any kind, and an insurance company is on the other side you will want to seek advice.  Another way to look at this problem is to follow this general rule:  if you are dealing with anyone that calls themselves an "adjuster" or "claim handler" or uses the words "risk management" then you will want to seek legal advice to at least be certain you are not being taken advantage of.
